Step by step

Decide a conflict review

A partner or the compliance officer takes a conflict search waiting for a decision, checks each match, and clears it, approves it on conditions or declines the instructions.

Every conflict search that finds something waits for a reviewer. The reviewer decides whether the firm can act, and Kila keeps the decision, with who made it and why, in a history that cannot be changed.

You need the right to review conflicts. At Wanjiru & Otieno Advocates the partners and the compliance officer have it; the receptionist and the advocates run searches but do not decide them.

  1. Open the search

Go to Practice › Intake › Conflicts. Waiting lists the searches waiting for a decision, with their possible matches, state and reviewer. Tap the one to decide.

  2. Tap Take it

Kila says Taken for review. and the review is Under review, so others can see someone is on it.

  3. Check each match

Each match says what matched and where Kila found it, with a link to the enquiry or matter. Open them and decide whether any is a conflict for these instructions. Search again adds names: “More names or a corrected spelling: the new matches join this review.”

  4. Choose the decision

    • Clear: none of the matches is a conflict.
    • Approve on conditions: “Write the conditions: an ethical wall, the clients’ written consent, a limit on the scope.” Tick An ethical wall is needed to choose who is screened off: “The wall waits for a second person’s approval (Security policies).”
    • Decline: “The enquiry closes as declined (conflict of interest).”
    • Escalate: “To a partner who reviews conflicts (the person named on a hit you cannot see).”
    • Ask for a waiver: “A partner decides in Approvals (never the person asking).”
  5. Say why, then confirm

To clear, Kila asks: “Say why none of the matches is a conflict for these instructions.” Write it under Reason and tap Clear. The button stays grey until there is a reason.

Clear the search: the reason that the matches are this enquiry itself (3), and the Clear button (4).Clear the search: the reason that the matches are this enquiry itself (3), and the Clear button (4).
  6. Read the decision

Kila says Cleared. The review shows who Decided, when and why, and the Decision history adds the step, each entry sealed to the one before, such as “Whole and unchanged (4 entries, each sealed to the one before).”

The review now Cleared: Decided by Tom Otieno with his reason (5), and the decision history, whole and unchanged (6).The review now Cleared: Decided by Tom Otieno with his reason (5), and the decision history, whole and unchanged (6).

The law says

Each review names the rule it rests on: “Advocates Act (Cap. 16) and the LSK Code of Standards of Professional Practice and Ethical Conduct: an advocate does not act where there is a conflict of interest without informed consent. Verify with the firm.”

Tap Reopen on the review and give the reason: “Something new came up: the review is under review again.”

Kila shows only whom to ask. Tap Escalate and choose that partner: they decide.

Next: with the search cleared, identify the client: Identify a client.
