Run a conflict search

Before the firm takes instructions, search every name involved. Kila shows what matched and why, and keeps the search for a reviewer to decide.

A conflict search looks for every name on new instructions among the firm’s clients past and present, the parties on its matters and their advocates, its enquiries and the people related to its clients. Run it before anyone gives advice. Someone else then decides whether the firm can act.

  1. Open the Conflicts tab

Go to Practice › Intake and tap Conflicts. The page says: “Search before taking instructions; reviews waiting for a decision.”

  2. Type every name involved

Type one name in A name (a person or an organisation), then tap Another name for the next. Kila asks for “Everyone involved: the client, the other side, their advocates, guarantors, directors.”

  3. Add the numbers you have

Add any ID, passport, registration or KRA PIN numbers (separate them with commas) and Phone numbers. Under Why (optional), say what the instructions are about.

  4. Tap Search

Kila searches straight away and keeps the search: “Close spellings match too (from 88% alike). Every search is kept in the register.” It says what it found, such as 3 possible matches: CC-00099 waits for a reviewer., and opens the review.

  5. Read what matched

Possible matches lists each one with what matched, such as the same name as “Joseph Ndungu Gitau” or the same phone +254712406118, where Kila found it (such as Enquiry, Named on an enquiry or Advocates acting) and how alike it is. The review shows its state, the Reviewer and the date to Decide by.

Conflict review CC-00099, a potential match: three possible matches on the enquiry ENQ-00001, each with what matched (5), and the review's state, reviewer and decide-by date (6).Conflict review CC-00099, a potential match: three possible matches on the enquiry ENQ-00001, each with what matched (5), and the review's state, reviewer and decide-by date (6).

A reviewer, a partner or the compliance officer, then clears the search, approves it on conditions or declines the instructions: Decide a conflict review.

The law says

Each review names the rule it rests on: “Advocates Act (Cap. 16) and the LSK Code of Standards of Professional Practice and Ethical Conduct: an advocate does not act where there is a conflict of interest without informed consent. Verify with the firm.”

The search card says: “For an enquiry, search from the enquiry (its people are added).” Open the enquiry from Practice › Intake and tap Conflict search there. The enquiry lists it under Before it becomes a matter, with the identification and the engagement.

Kila shows:

1 possible conflict you may not see

They are on matters or clients you may not open. Escalate to the person named: they decide.

The match says only whom to ask, such as “A possible conflict on a matter or client you may not open. Ask Tom Otieno.” Leave it to the reviewer, or tap Escalate and choose that person.

Kila says Nothing found with the search’s number, and clears it itself: “Nothing matched among clients, former clients, enquiries, parties and related persons: cleared by the system.”

Type at least one name of two letters or more, or a number.

Next: once the search is cleared, the client is identified and the engagement is accepted, the matter can open: Open a matter.
